Employers be warned!

A Trend is emerging where job candidates exploit age discrimination legislation to file claims against a raft of employers at the same time!

According to law firm EMW Picton Howell, claimants are making claims against employers if they send their CV for a position that includes their age details, and do not receive a response.

Margaret Keane, a 50 year old woman, won a number of out-of-court payouts ranging from £4000 - £10,000 when she sued up to 22 Accountancy Firms when they did not reply to her job application.

An employent tribunal ruled in 5 of her cases and concluded that she was a "Serial Litigator" rather than a genuine Job Applicant .
Legal experts believe this could cause the floodgates to open for similar damage claims, as employees make "Copy Cat" claims.

A spokesperson at EMW Picton Howell, commented "its like entering a lot of competitions; the more you enter, the better the odds of winning!"

Whatever the outcome of the cases, companies involved face

  • very substantial legal fees
  • loss of management time
  • a black mark against their name if the claim does succeed
  • out of court settlement funds to avoid negative publicity
  • negative publicity
